Personnel issues often pose difficult problems for school district leaders. Frequently, these issues involve the proper allocation of human resources, and decisions must be made about transfers and personnel reassignments. Staff members who are the subject of a transfer or reassignment may challenge the action as a violation of their tenure rights or on the grounds that the action was taken for disciplinary and/or discriminatory reasons. To better understand a board of education’s authority and the rights of employees, this Administrative Guide discusses the transfers and reassignments of district personnel.
The November School News Briefs discusses four new cases, including one case in which the Appellate Division found that the State Board of Education did not act unlawfully in adopting Administrative Code regulations that eliminated gendered pronouns and used more inclusive language.
The Special Education Bulletin reviews three new cases, including one in which the United States District Court for New Jersey held that a board does not waive or forfeit its right to contest the fee charged for an Independent Educational Evaluation simply because it initially agreed to fund the evaluation.
